INDUSTRIAL DESIGNS - Governed by Designs Act,2000

The most important attributes of Design are shape, configuration, ornamentation, surface pattern, of lines or colours, which is applied to any article either in two dimensional or three dimensional or in both forms, by any industrial process or means, be it manual, mechanical or chemical, either separate or combined, which in the finished article appeals to and are solely judged by the eye; but does not include any mode or principal of construction or anything which in substance is a mere mechanical device, and not including any trade mark, property mark or artistic mark.

Validity Based On

Novelty or Originality in a Design applied to a product to add aesthetic value.

Exclusive Rights Granted

Providing exclusive copyright to apply such designs on product/articles covered to claimants of new/original designs.

Period of Such Exclusive Rights

Maximum 15 Years

Nature of Specialization Involved

  • Guiding clients for valuable statutory coverage under the Designs Law by suggesting effective representations of designs to benefit the effective coverage of new or original design features under the Indian Law.
  • Assessing the scope of protection of industrially applicable new / original shape, configuration or ornamental patterns of articles under the Designs law;
  • Opining on need for single or multiple coverage for effective protection and ascertaining views of the design for such purpose;
  • Preparation of legal brief and representing in design cancellation proceedings and infringement issues;
  • Regular filing, prosecution and attending contested matters both before the Controller of Designs and the various Courts/Tribunals in India including Cancellation of Designs and Infringement issues.
  • Maintenance of copyright in Regd. Designs.
